Who Can Possess Marijuana?
Thanks to the recent Prop 64 laws, people over 21 are able to buy cannabis without a medical recommendation. This means that so long as you are not in possession of an amount over the legal limit, you are operating within the law. However, this does not stop some police officers from alleging that you were doing something illegal. In California, it is illegal to use marijuana while:
- Driving a car
- Visiting a public place that is not licensed for cannabis consumption
- At a school, daycare center, or youth center
You are also prohibited from growing marijuana anywhere that is visible to the public. You also cannot provide marijuana to anyone under the age of 21. The legal possession amount is 28.5 grams, which is about 1 ounce.
What are the Penalties for the Unlawful Cultivation of Marijuana?
Under Proposition 64, it is lawful for adults over the age of 21 to grow up to six marijuana plants. Unlawful cultivation of marijuana (6 plants or more) is a misdemeanor charge and punishable by up to 6 months in jail and a $500 fine.
